1. ACCEPTANCE OF TERMS Welcome to Story Bank, a service provided by Art & Audience (the “Company”, “We”, “Us”). By accessing, registering for, or using the Story Bank service (the “Service”), you (“User”, “Customer”, “You”) agree to be bound by these Terms of Service (“Terms”) and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Service.

2. DEFINITIONS 2.1 “Service” means the digital registration and timestamping platform, branded as Story Bank, operated by Art & Audience for the purpose of creating verifiable records of creative works. 2.2 “Platform” refers to the web-based application, portal, and associated systems accessible through our domain. 2.3 “Digital Certificate” means the cryptographically secured timestamp certificate issued upon successful completion of the registration process. 2.4 “Authorized Email” means email addresses verified through our payment and registration process and granted access to the secure submission portal. 2.5 “Encrypted Document” means password-protected PDF files submitted through our secure upload system.

3. DESCRIPTION OF SERVICE 3.1 The Story Bank service provides a digital timestamping service that creates verifiable, timestamped records of creative works including but not limited to scripts, stories, lyrics, and other intellectual property. This service provides a verifiable timestamp and serves as strong evidence, but it is not a substitute for official notarization as defined under the Notaries Act, 1952. 3.2 The Service operates through a two-step process: (i) registration and payment verification, and (ii) secure document upload with cryptographic verification. 3.3 Upon successful submission, Users receive a digital certificate providing proof of submission timestamp, which may be used as evidence of creation date for intellectual property purposes, subject to legal limitations.

4. REGISTRATION AND ELIGIBILITY 4.1 Age Requirement: Users must be at least 18 years of age to use this Service. Users under 18 may only use the Service with verifiable parental or legal guardian consent, in line with applicable data protection laws. 4.2 Capacity: Users must have the legal capacity to enter into binding contracts under the Indian Contract Act, 1872. 4.3 Accuracy of Information: Users must provide accurate, current, and complete information during registration. Providing false information constitutes a breach of these Terms. 4.4 Single Use: Each registration permits one (1) secure document submission. Additional submissions require separate registration and payment.

5. PAYMENT TERMS 5.1 Fee Structure: The Service fee is ₹1,999 plus applicable GST, payable in advance through secure third-party payment processors. 5.2 Payment Processing: All payments are processed through third-party payment gateways in accordance with their terms and conditions. Art & Audience does not store payment card information. 5.3 No Refunds: Given the nature of digital registration services, all payments are final and non-refundable upon successful completion of the registration process, unless required by consumer protection laws. 5.4 Payment Verification: Access to the secure submission portal is contingent upon successful payment verification. Failed or fraudulent payments will result in immediate account termination.

6. USE OF SERVICE 6.1 Permitted Use: The Service may only be used for legitimate intellectual property protection purposes in accordance with Indian law. 6.2 Document Requirements: Only encrypted PDF documents are accepted. Documents must be password-protected using strong encryption. Maximum file size limitations apply as specified in the portal. Documents must not contain illegal, defamatory, or infringing content. 6.3 Prohibited Activities: Users shall not: Submit documents containing illegal, harmful, or infringing content. Attempt to circumvent security measures or access controls. Use the Service for fraudulent purposes. Submit documents that violate third-party intellectual property rights. Reverse engineer, modify, or create derivative works of the Platform. 6.4 Data Integrity: Users are responsible for verifying document integrity before submission using available verification tools.

7. INTELLECTUAL PROPERTY 7.1 User Content: Users retain all intellectual property rights in their submitted documents. Art & Audience claims no ownership rights in User content. 7.2 Service IP: All rights, title, and interest in the Platform, Service technology, and digital certificate format remain the exclusive property of Art & Audience. 7.3 License Grant: Users grant Art & Audience a limited, non-exclusive license to store, process, and maintain submitted documents solely for the purpose of providing the Service.

8. DATA SECURITY AND STORAGE 8.1 Security Measures: Art & Audience employs industry-standard security measures, including encryption for transmission and storage, multi-factor authentication, and regular security audits. 8.2 Document Storage: Submitted documents are stored securely in encrypted form with metadata including submission timestamp, user identity, and verification data. 8.3 Access Controls: Access to stored documents is restricted to authorized personnel, with logging and monitoring in place.

9. LIMITATION OF LIABILITY 9.1 Service Limitations: The Digital Certificate provides evidence of document submission timestamp but does not constitute legal advice, official notarization, or guarantee legal protection of intellectual property rights. 9.2 Liability Cap: To the maximum extent permitted by law, the total liability of Art & Audience to any User shall not exceed the fees paid by such User for the Service. 9.3 Exclusion of Damages: Art & Audience shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities. 9.4 Third-Party Services: Art & Audience is not liable for failures or issues arising from third-party services, such as payment processors or infrastructure providers.

10. INDEMNIFICATION Users agree to indemnify, defend, and hold harmless Art & Audience, its proprietor, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from: User’s breach of these Terms. User’s violation of applicable laws. Content of submitted documents. Unauthorized use of User’s account.

11. FORCE MAJEURE Art & Audience shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, government actions, internet outages, cyberattacks, or other force majeure events as recognized under Section 56 of the Indian Contract Act, 1872.

12. TERMINATION 12.1 Automatic Termination: User accounts are automatically terminated upon successful document submission, in accordance with our one-time use model. 12.2 Breach: Art & Audience may immediately terminate access for violation of these Terms or applicable law. 12.3 Effect of Termination: Upon termination, User’s right to access the Platform ceases, but stored documents and issued certificates remain valid.

13. COMPLIANCE AND LEGAL FRAMEWORK 13.1 Applicable Law: These Terms are governed by the laws of India, including but not limited to the Indian Contract Act, 1872; Information Technology Act, 2000; Digital Personal Data Protection Act, 2023; and Consumer Protection Act, 2019. 13.2 Jurisdiction: Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka, India. 13.3 Regulatory Compliance: The Service operates in compliance with applicable Indian regulations governing digital services and data protection.

14. DISCLAIMER 14.1 No Legal Advice: Art & Audience does not provide legal advice. Users should consult qualified legal professionals regarding intellectual property protection strategies. 14.2 Service Availability: While Art & Audience strives to maintain continuous service availability, we do not guarantee uninterrupted access and may perform maintenance or updates as necessary. 14.3 Technology Limitations: Digital certificates provide evidence of submission timestamp but do not establish authorship, originality, or legal ownership of intellectual property.

15. MODIFICATIONS Art & Audience reserves the right to modify these Terms at any time. Material changes will be communicated through email or platform notifications. Continued use after modifications constitutes acceptance of revised Terms.

16. SEVERABILITY If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
